even if it's not free anymore, it is still uploaded under Non-free use rationale template, and reason behind its usage is provided and qualifies as a fair use per Section 107 of the Copyright Act law. so doesn't this mean i can use it regardless?

Hi بەکارھێنەر:Sakura emad! If the file qualify for fair use then the problem can be solved by replacing the free license template with the relevant non-free license template.
However I do not think that it is possible to argue that a copyrighted photo of a lady with a hat is needed to illustrate an article about skin. There are many photos of ladies with a hat on Commons and it is possible to make a new photo if you want a photo of a lady in a net blouse.
